I am developing a software and want to use a fair EULA. I will be having an attorney review it but its faster and cheaper attorney fees if you bring them one already somewhat drafted instead of them starting from scratch. Where might I find a fair and enforceable EULA that protects my company and its users? www.edimate.com

The debate usually rages over whether aspects of a EULA are enforceable, but I think there will always be a problem with clicking "I have read and accept the terms" when you have _not even read them_. There's something wrong with that, bad karma if you will. I'm working on a service that addresses that particular problem, by leveraging the crowd, so that you can skip reading most of the EULA without harming your karma. I'm hoping to start the service with crowd funding, i.e. kickstarter or similar, see www.x2xroads.com

Unfortunately EULA:s are so long no one reads them and therefore don't know if they're abusive. Thanks for giving us the option of simplifying them!

Agreements are one of the most appropriate marketing way to get all such things clear in front of the visitors. So there are other ways where you can go in a very clear way ahead with the agreement part as well

I like this idea. I fear that some copyright troll may pick it up and abuse it. Take a look at http://creativecommons.org. If I understand correctly, you may claim copyright to your work (to prevent others from taking "ownership"), yet also allow anyone to openly and legally recreate your work.

Love this - my Company's T&C state:

"### explicitly rejects any automatically renewing contracts. If you hide such terms in your small print take notice that we reject these terms, and will refuse payment and take necessary steps to recover any money taken from us in connection with automatic renewals unless you are in possession of a written or verbal acknowledgment of the renewal and the terms of that renewal given at the time of the renewal, or else clear evidence that these terms were brought to our attention at the time of our entering into contract with you."

We test this in court against NPower some time in the new year - stay posted
